VILLAGE OF MURRAY, NEBRASKA
March 9, 2021
The Murray, Nebraska Board of Trustees met in regular session on Tuesday, March 9, 2021, at 7:00 pm in the Murray Municipal Building. Present: Trustees: Stan Flak, Jeff Anderson, George Blessing, Don Strong; Village Clerk: Shelli Hayes, Maintenance Operator Jerome Speck; and guests. Absent: Trustee Theresa Sallach.
Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes. Notice of the meeting was simultaneously given to the Chairman and all members of the Board of Trustees. Their acknowledgement of receipt of notice and agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.
Chairman Flak called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.
Approval and/or correction of the minutes of the February 9, 2021 regular meeting. Motion by Blessing, seconded by Anderson to approve the minutes of the February meeting; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Treasurers Report. Motion by Blessing, seconded by Anderson to acknowledge receipt of the Treasurer’s report; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Claims approval. Motion by Blessing, seconded by Strong to approve the claims as revised; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Emergency Management Report.
Maintenance Report.
Motion by Flak, seconded by Blessing to approve the bid from Ty The Fence Guy to repair the fence at Young Park ($1,210.17) and the backstop at Tyson Park ($972.82), with two separate invoices; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Planning Commission Report.
Motion by Flak, seconded by Anderson to approve a building permit for Heath Marrinan, 8019 12th Street, for a pre-engineered metal building; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Motion by Flak, seconded by Blessing to approve a revision to the non-conforming agreement for Carrie Dohlman at 713 E Main, to include five (5) cows and five (5) calves; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Motion by Anderson, seconded by Strong to approve use of village property for the Murray Freedom Festival, July 4, 2021; ayes: Anderson, Strong, Flak; abstain: Blessing; motion carried.
Motion by Flak, seconded by Blessing to approve the bid from American Legal Publishing to update Murray Code of Ordinances for $2,988.00 minus 10% for 8 copies instead of 15; ayes: Anderson, Blessing, Strong, Flak; motion carried.
Motion by Blessing, seconded by Strong to approve Resolution # 21-02, Stanton/Campbell Street Easement, 509 E Campbell; ayes: Flak; nays: Anderson, Blessing, Strong; motion failed.

Motion by Blessing, seconded by Anderson to exit executive session at 8:37 pm; ayes:

Carrie Dohlman spoke requesting a revision to the non-conforming agreement for her property at 713 E Main; the matter was tabled until next month’s meeting to allow input from neighbors.
Discussion regarding vacant buildings.
Motion by Sallach, seconded by Flak to approve Resolution #21-01 to increase sewer rates by 7%; ayes: Sallach, Flak; nays: Anderson, Strong; motion failed.
Motion by Flak, seconded by Sallach to approve Resolution #21-01 to increase sewer rates by 6%; ayes: Anderson, Sallach, Strong, Flak; motion carried.

Discussion regarding the matter of nuisance at 406 E Campbell; nuisance has been satisfied.
Discussion regarding the disposition of Barry Road.
The matter of model ordinances for compliance with legislative changes was tabled to allow time for further review by Village Attorney and Clerk.
